City Vehicle Usage Agreement

  2. CITY VEHICLE USAGE AGREEMENT
    The City of Canyon, in an effort to beautify our city and assist the residents, offers the use of the city truck, when available, on a first come, first served basis, for the removal of trash, tree trimmings, shingles, etc. If you have any large items, please place them on the truck last. The city limits private usage of this truck to 3 times per calendar year. You MAY NOT place Batteries, Tires, Oil, Paint, Dirt, Brick, Concrete, Asphalt, Antifreeze or Refrigerated Appliances in the truck! The tailgate MUST be able to be completely closed and all debris must be secured and remain in the truck during transit. Any items listed previously that are placed in the truck will be returned to the residence. The City of Canyon restricts the use of city vehicles to individuals who are performing work for themselves on property they own/rent within the city limits. Work that is performed for pay is not eligible for this service. Any materials generated by contractors shall be disposed of by the contractor’s or owner’s expense. It is not the intention of the City for this truck to be used to clean up after construction projects that generate debris in amounts greater than 7000 lbs. If the load limit is exceeded or prohibited materials are placed in the truck, a charge of $200.00 will be paid by the person requesting the vehicle. The truck will be parked in a driveway, front yard, or on a street and will be picked up the next workday morning. ONLY city employees will be allowed to drive any city vehicle due to insurance restrictions. The hydraulic tailgate will be locked in the lowered position and will not be available for use by residents using the truck. Any material on the tailgate and not in the bed of the truck will be returned to the residence. The following is an agreement between the undersigned and the City of Canyon for use of a city vehicle under the terms stipulated above. A paper copy of this agreement is available to be filled out in our Public Works office located at 301 16th Street in Canyon.
  3. The City of Canyon currently follows CDC Guidelines and practices social distancing to prevent the spread of Covid-19.

  7. Date chosen must be a FRIDAY in order to be approved. Truck is dropped off on a Friday unless there is a holiday. On holidays, the truck will be dropped off the last working day of the week.
  8. Date chosen must be a MONDAY in order to be approved. Truck is picked back up the following Monday after the truck is dropped off unless there is a holiday. On holidays, the truck will be picked up the first working day of the following week.

    I, the applicant whose name is listed above, do hereby certify that I am the person listed above and that I own/rent the property listed above and that the items to be hauled by the city vehicle are from my property. I also certify that the items to be hauled were not generated by anyone being paid for services. I understand and agree that if the work was done by someone else that I am to pay the City of Canyon a sum of two hundred dollars($200.00) for each time I have used the city vehicle. I also understand and agree that if the truck is overloaded, I am to pay the City of Canyon a sum of $200.00
  11. THE TERMS AND CONDITIONS BELOW APPLY TO THE USE OF THE CITY TRUCK
  12. RELEASE, WAIVER AND INDEMNITY*
    The undersigned hereby releases the City of Canyon and waives any liability on the part of the City for all injury, loss or damage of every kind or character to persons or property, including personal injury or death, which may arise from use of the City truck, and holds the City, its agents, servants, employees, elected or appointed officials harmless from all injury, damage, Judgments or claims arising from use of the City truck, including attorney fees and expenses incurred in the defense of any such claim. The undersigned covenants that he or she will not cause, suffer or permit any claim to be filed or asserted against the City for loss, injury, or damage to persons or property arising from our caused by the use of the City truck. Should any such damage claim be filed in violation of this covenant by or on behalf of the undersigned against City or anyone associated with City or any of City’s employees, agents, servants, elected or appointed officials, the undersigned shall pay and indemnify City of and from the effect of any judgment or award entered or rendered including, without limitation, attorney fees and other cost of defense including expert witness fees.
  13. THIS RELEASE EXTENDS TO AND INCLUDES RELEASING THE CITY EVEN IF DAMAGE IS CAUSED BY THE NEGLIGENCE OF CITY EMPLOYEES OR AGENTS.
    Venue of any dispute shall be in Randall County, Texas.
  14. Please allow at least 3 business days between date of application and desired truck usage date to obtain approval confirmation via email. Truck is available on a first come, first served basis and may not be available on the dates you selected.
